Acceptance of Terms

By accessing or using the Menon Mobility platform, including our website, mobile applications, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, users, buyers, sellers, and others who access or use the Service. Menon Mobility operates an online marketplace for buying and selling commercial vehicles and machinery, including trucks, trailers, construction equipment, buses, agricultural machinery, containers, vans, cars, and related parts and accessories.

Eligibility

To use the Service, you must be at least 18 years of age and able to form a legally binding contract under the applicable law. By using the Service, you represent and warrant that you meet these requirements. If you use the Service on behalf of a business or other legal entity, you represent that you are authorized to bind that entity to these terms, in which case "you" refers to that entity.

Your Account

When you create an account, you must provide accurate, current, and complete information and keep it up to date. You are responsible for safeguarding your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials. We reserve the right to suspend or terminate accounts that violate these terms.

Our Role as a Marketplace

Menon Mobility provides an online marketplace platform that connects buyers and sellers. We act solely as an intermediary and are not a party to any transaction between users. We do not own, sell, purchase, inspect, warrant, or take possession of any items listed on the platform. Any sales contract or agreement is concluded directly between the buyer and the seller, and each is responsible for fulfilling their respective obligations under that contract. Menon Mobility does not guarantee that a buyer or seller will complete a transaction and is not responsible for the performance, conduct, or reliability of any user. We strongly encourage buyers to inspect items in person and verify all details before completing a purchase.

Listings and Seller Obligations

Sellers are solely responsible for the accuracy, completeness, and legality of their listings, including descriptions, images, specifications, pricing, availability, and any legal disclosures. Sellers must have the right to sell the items they list and must comply with all applicable laws and regulations. Listings are subject to moderation and approval, and new listings may be reviewed before they become publicly visible. We reserve the right to edit, refuse, remove, or unpublish any listing at our discretion, including listings that are inaccurate, misleading, prohibited, or unlawful. Prohibited or illegal items may not be listed. Some listings on the platform may be imported sample or demonstration ("DEMO") data used for illustration purposes and may not represent items that are actually available for sale.

User Conduct and Prohibited Use

You agree not to use the Service to:

• Post false, misleading, fraudulent, or deceptive listings or information
• Engage in any unlawful, fraudulent, or infringing activity
• Infringe the intellectual property or other rights of any third party
• Harass, abuse, threaten, defame, or otherwise harm other users
• Post objectionable, offensive, hateful, or discriminatory content
• Attempt to circumvent, disable, or interfere with any security features
• Scrape, harvest, or collect data from the Service without our permission
• Introduce viruses, malware, or other harmful code
• Post spam, unsolicited advertisements, or attempt to divert transactions off-platform to evade fees

User-Generated Content and Messaging

The Service allows users to create listings, send messages, and submit other content. You are solely responsible for the content you post and the messages you send, and you must ensure they comply with these terms and all applicable laws. We operate a zero-tolerance policy for objectionable content and abusive behavior. We may review, moderate, remove, or disable access to any content that violates these terms or that we consider objectionable, and we provide tools to report and block other users. We aim to act on reports of objectionable content and abusive users, which may include removing the content and suspending or terminating the responsible account. While we may moderate content, we are not obligated to monitor all user activity and are not responsible for content posted by users.

Subscriptions and Payments

Certain features of the Service require payment of fees, including subscription plans and featured-listing fees. Paid plans and fees are billed through our payment processor, Stripe, on the Menon Mobility website. All fees are stated in Euros (EUR) unless otherwise specified and are exclusive of any applicable taxes unless stated. Subscriptions may renew automatically for successive billing periods unless cancelled before the renewal date, and you may cancel a subscription at any time, with cancellation taking effect at the end of the current billing period. Fees are non-refundable except where required by applicable law. We reserve the right to change our pricing, with reasonable notice to affected users. Please note that the Menon Mobility mobile application itself does not process payments; payments are handled on the website.

Intellectual Property

The Service and its original content, features, functionality, logos, and trademarks are owned by Menon Mobility and are protected by international copyright, trademark, and other intellectual property laws. You may not use our name, logos, or marks without our prior written permission. You retain ownership of the content you submit, including your listing content, but you grant Menon Mobility a non-exclusive, worldwide, royalty-free license to host, use, reproduce, display, and distribute that content for the purpose of operating, promoting, and providing the Service.

Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, or secure, and we make no warranty regarding the quality, safety, legality, or accuracy of any listing or item, or the conduct of any user. To the maximum extent permitted by applicable German and European Union law, Menon Mobility shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from transactions or dealings between users. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Termination and Suspension

We may suspend or terminate your access to the Service, remove your content, or close your account at any time, with or without notice, if you violate these terms, if we are required to do so by law, or if we reasonably consider it necessary to protect the Service or other users. You may stop using the Service and close your account at any time. Upon termination, the provisions of these terms that by their nature should survive, including intellectual property, disclaimers, limitation of liability, and governing law, will continue to apply.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict-of-law provisions and without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence. Any disputes arising out of or in connection with these terms shall be subject to the jurisdiction of the competent courts in Germany.

Changes to These Terms

We may update or modify these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised terms. If you do not agree to the updated terms, you must stop using the Service.
